A PostalMag.com reader says they have contacted the USPS OIG about their supervisors falsifying clock rings. However, according to this reader, the OIG said the Department of Labor investigates such complaints. However, according to this reader, the Department of Labor said the USPS should investigate these complaints. So I want to know, who is supposed to investigate?

I am no expert, Tom, but there is something referred to as the "Little Tucker Act" - link: http://www.law.cornell.edu/uscode/28/1346.html. As you will read, it states that the juridisction of Postal monetary and FLSA matters should be investigated internally such as through the Postal Inspection Service. The same recently enacted dreaded Postal Reorganization and Enhancement Of 2006 (which has decreased our workhours) states in Section 409A - "the USPS shall be amenable for all lawful and unlawful acts in the name of the USPS. The more specific waiver of sovereign immunity provided in cases solely involving the USPS, which expressly governs jurisdiction of suits against the USPS, endows any court decision with the jurisdictional authority to decide this case." |
